Bank Alfalah provides end users with access to the IFC Interim Global Package only pursuant to a signed agreement or click-wrap agreement that expressly includes: (i) an acknowledgement of the proprietary rights of IFC and all Content Providers in the IFC Interim Global Package; (ii) terms and conditions consistent with and no less restrictive than those set forth in this Section 5 of this Agreement; (iii) terms and conditions that are no less protective of IFC and Content Providers than, and are substantially similar to, those undertaken by Organization under this Agreement with respect to attribution, indemnification, disclaimers of warranties and liability, warranty of no conflicting agreements or obligations, termination, inappropriate content, Content Providers’ third party beneficiary status, and governing law. Organization shall be responsible for conforming any such agreement so that it is legally enforceable and complies with industry best practices and Applicable Law in the Territory, and shall use commercially reasonable efforts to enforce such terms and conditions against End Users
